Terms and Liability

Airline companies worldwide operate according to various agreements and their liability is limited by international treaties and local laws.  Before booking a flight on Israir Net, users are advised to read the terms of agreement of the airline company operating the flight.  If the user wishes to obtain a copy of the terms of the arrangement with the airline company operating his flight, he can obtain this information from the Israir offices, on condition he has made the flight booking on Israir Net.
The terms of the arrangement between Israir and passengers on its scheduled domestic flights and between Israir and passengers on its international flights (charter and scheduled) are specified below in these Regulations.
If the services booked by the user are not supplied by Israir, Israir shall be deemed only the intermediary between the user and the airlines and/or hotels and/or agents and/or tourism wholesalers specified on the site, and therefore Israir shall have no liability, either directly and/or indirectly, for any damage and/or loss caused due to faults in or defective performance of such services, and such liability shall rest solely with the suppliers of those services, according to their terms of service.
Israir and/or any of the site operators and/or any of its directors and/or agents are not liable for ensuring that the site server is free of viruses and/or other elements that could damage the computer and/or other equipment following entry to the site.  In addition, Israir is not liable for any damage caused due to any failure and/or delay when trying to access the site.
Israir shall not be liable for any illegal activity done and/or existing on the site by the user and/or other person.
The user shall indemnify and/or compensate Israir and/or its agents for any claim and/or expense and/or damage and/or legal costs incurred by Israir as a result of his use of the site.

Changes to the Services or their Discontinuation

Israir may at any time cease activity on the Israir Net site, use of some or all of the services offered on the site, including the links to other sites, and cancel the purchase of such services by the user without prior notice.  Israir may refuse to grant access and/or cease access to Israir Net or parts of it by any user and at any stage, at its sole discretion and without prior notice.  Israir may from time to time change the structure of the Israir Net site, including its appearance, its content, the scope and availability of the services offered on it, and any other aspect of the Israir Net site and the services, and all without prior notice.

Terms of Use of the Site

Any person who holds a valid credit card from one of the credit companies indicated below may purchase services through the Israir Net site.  The credit companies are:  Visa K.A.L., American Express, Leumi Visa, Isracard and Mastercard.  Without detracting from the foregoing, a precondition for confirming purchases on the site is obtaining the approval of the credit card company for the transaction to which the user is committing.  This site may not be used for any purpose other than booking and purchasing the various services and/or obtaining information about them.

Booking Procedure on the Site

On the “Booking” screen fill in the details of your chosen booking, the details of your credit card and other details asked for on the form.  Any mistake made by the user in entering the purchase details, including an error in selecting the flight destination, number of tickets and/or quantity of services ordered and/or an error in entering the passengers’ ages is solely the user’s responsibility.  Israir and/or the other service providers shall not bear any liability whatsoever whether directly and/or indirectly if the user’s booking is not accepted by the system for any reason and/or for any technical fault and/or other reason that prevents the user from purchasing the services through the site.
Entering false purchasing details, including invalid credit card details or for a credit card which the user is not entitled to use, constitutes a criminal offense.  Legal steps will be taken against users who give false information, including claims for any damage caused to Israir and/or any of the other service providers and/or their agents, due to and/or in connection with the provision of false information.
Until the booking is confirmed by Israir, for Israir and/or the other service providers the booking is deemed an irrevocable request by the user to purchase the services booked.
Israir does not undertake that the user’s request will be answered by it and/or by the other service providers and/or that it will receive any priority over other bookings, including those made later.
Confirmation of the booking will be given by the telephone service clerk or by fax or email, according to the details given by the user.
Users should note, the booking is deemed irrevocable once it is submitted and therefore will be subject to a cancellation fee, as described later in these Regulations, even if the user cancels the booking before it is confirmed by Israir.
Confirmation of the booking is conditional on the customer signing the deal confirmation form and sending a photocopy of the credit card and the credit card holder’s ID if necessary.

Price and Payment on the Site

The prices published on the Israir Net site change in accordance with Israir’s pricing policy.
Prices given in a foreign currency will be collected according to the high exchange rate for transfers and drafts of that currency on the day of payment.   The payment will only be debited after confirmation of the booking by Israir  /Disenhaus Incoming Tourism .

After the order is placed, it is treated as a request until final confirmation from the various suppliers.  Final approval of the booking will be given by the Israir call center clerk / Disenhaus clerk.  If there is a discrepancy between the prices published on the Israir Net site and the prices in force at the time of the booking, the price given to the customer by the Israir clerk Disenhaus clerk  shall be the actual price.

A user who is registered as a customer is entitled to a discount based on age.  He must show identity confirming his eligibility for the discount.  If he does not show suitable identity, he will be charged the difference when he comes to receive the services for which the discount was given, or at a later date by means of the credit card whose details he gave and/or by any other means.

Purchases made over Israir Net do not entitle the user to any discounts, including discounts granted to members of certain groups and/or clubs, except as specified explicitly on the Israir Net site.

General information about flights

Flights are operated by different airline companies, whether as charter flights  which by their nature could be subject to cancellations, delays, changes in route and/or flight number and/or operating company at the last moment pursuant to any law, or whether as schedule flights.  Flights are operated by the air carrier (the airline) pursuant to its terms and responsibility, including responsibility for delays, changes, early departures, cancellations, and loss/ delay or damage to baggage pursuant to any law, including limitations of this liability, including limitations by virtue of the Warsaw Convention.  Attention is drawn to the terms of the contract of carriage.  Further practical information about flights can be found on the Israir internet site and/or obtained from the Israir offices.

Terms of the contract of carriage

1. In this contract, “ticket” means this passenger ticket and baggage ticket, and in the case of an electronic ticket, if applicable, this itinerary/ receipt, of which the terms and notices form part;  “carriage” has the same meaning as “transportation” and “freight”;  “carrier” refers to all carriers who carry or undertake to carry the passenger or his baggage pursuant to this contract or to perform any other service relating to such air carriage.  “Warsaw Convention” means the treaty that combines certain rules regarding international air carriage, that was signed in Warsaw on October 12, 1929 or this treaty as amended in The Hague on September 28, 1955, all as applicable.

2. Carriage pursuant to this Contract is subject to the rules and restrictions relating to liability as determined in the Convention, unless such carriage is not “international carriage” as defined in the Convention.

3. To the extent that this does not conflict with the provisions included above, all carriage and other services provided by any of the carriers are subject to:  (1) the terms included in this ticket;  (2) applicable tariffs;  (3)  the carrier’s terms of carriage and the associated regulations, which form an integral part of these conditions (and which on request may be viewed at the carrier’s offices), except for transportation between a location in the United States or Canada and any location outside those countries, which is subject to the tariffs in force in those countries.

4. The carrier’s name may be indicated on the ticket in brief;  the full name and its abbreviation are recorded in the tariffs, the terms of carriage, the regulations and the carrier’s schedules.  The carrier’s address shall be the airport at the departure location as indicated on the ticket against the first abbreviation of the carrier’s name;  the authorized stopping locations are those locations specified on this ticket or in the carrier’s schedules at the stopping locations recorded on the passenger’s itinerary;  transportation pursuant to this contract that is effected by a number of carriers consecutively shall be deemed provided by one carrier.

5. An air carrier who issues a ticket for carriage on the route of another air carrier does so as the agent of the said other carrier.

6. Any exemption from liability or limitation of liability of the carrier shall apply to its agents, employees and representatives and any other person whose aircraft are used by the carrier for the purposes of transportation, its agents, employees and representatives.

7. Baggage recorded as carried on international freight shall be delivered to the holder of the baggage ticket.  In the event of damage to baggage, a written complaint shall be submitted to the carrier, immediately on discovery of the damage and at the latest within seven days of receiving the baggage;  in the event of a delay, a complaint must be submitted within 21 days of delivery of the baggage.  Refer to the tariffs or terms of carriage referring to transportation that is not international.

8. This ticket is valid for carriage for a period of one year from its date of issue, unless otherwise stated on this ticket, in the tariffs, the carrier’s terms of carriage and the associated regulations.  Validity of the ticket is subject to payment of the price.  The fee for carriage, pursuant to this ticket, is subject to change before carriage begins.  The carrier may refuse to provide the carriage, if the applicable fee has not been paid.  If this ticket was issued for a charter flight, this ticket will be valid solely for the specific flight for which it was issued.

9. The carrier undertakes to make its best efforts to carry the passenger and his baggage within a reasonable time.  The carrier does not guarantee the times specified on the schedules or anywhere else, and they do not constitute part of this contract.   The carrier has the right, without notice, to use carriers or aircraft, substitutes and if necessary to change or remove any landing location specified on the ticket.  The schedules are subject to change without notice.   The carrier assumes no liability for connecting travel.

10. The passenger must comply with Government travel requirements, provide exit and entry documents and any other document required, and arrive at the airport at the time specified by the carrier, or if no time is specified, in good time to complete all departure arrangements.

11. No employee or representative of the carrier has the authority to change or waive any of the provisions of this contract.

12. The carrier shall have no liability for any damage due to a delay in transporting the passenger or baggage as specified in the Warsaw Convention with its amendments.

13. In the event of a problem regarding excess loading of the aircraft, the carrier shall decide at its absolute discretion, which passengers and which items of baggage will be carried and which passengers and which items of baggage shall not be carried on that flight.  A passenger whose travel is rejected as aforesaid has the right to cancel his ticket and be reimbursed for its cost.

14. Israir Charter and/or the carrier do not assume any liability for the disappearance, loss or theft of the flight ticket and the registered baggage ticket, and the passenger shall not be entitled to receive another passenger ticket and/or baggage ticket in place of those that were lost or stolen, nor to any right and/or refund for them.

Additional contract terms
1. a.  This flight ticket is for a charter flight to be operated by the air carrier whose name is stated on the carriage voucher (hereinafter:  “the carrier”) for the organizer (charterer), within the meaning of this term in the Charter Flight Regulations as in force from time to time in Israel, who has hired all or part of the aircraft’s capacity as an independent trader and not as an agent of the carrier.
b.  This flight ticket and carriage of the passenger thereby are subject to the terms of the contract between the carrier on one hand and the organizer (charterer) on the other hand.
c.   The passenger has purchased the right to carriage from the organizer (charterer) and therefore, the carrier is not liable for compliance by the organizer (charterer) with its obligations to the passenger or for any actions or omissions by the organizer (charterer) unless such liability applies to the carrier pursuant to the terms of the contract between the carrier and the organizer (charterer) or pursuant to any law.
d.  The organizer:  Israir Charter (1994) Ltd. and/or Israir International Limited Partnership.

2.   Notwithstanding the contents of section 8 of the terms of contract indicated on this flight ticket, this flight ticket is valid for transportation only on the dates and for the flights specified on it, or for other dates and flights as changed by the organizer or its representative.

Notice
If the passenger’s itinerary includes a final destination or stopover in a country other than the country of departure, the Warsaw Convention may be applicable and the Convention regulates and in most cases limits the carrier’s liability in the event of death or personal injury and also in the event of loss or damage to baggage.  See also under the heading “Notice to passengers on international flights regarding limitation of liability” and “Notice regarding limitation of liability for baggage”.

Notice to passengers on international flights regarding limitation of liability
Notice is hereby given to passengers on flights whose final destination or stopovers are in a country other than the country of departure, that the provisions of the Convention known as the Warsaw Convention may apply to the whole flight, including sections that are wholly within the country of departure or the destination.   For such travelers who are flying to the USA or from the USA or with an agreed stopover within the USA, the Convention and special contracts of carriage that are included in the tariffs applicable to the flight, include terms whereby liability of certain carriers who are parties to such special contracts for death or personal injury to passengers is limited in most cases to payment of proven damages that shall not exceed US$ 75,000 per passenger, and that liability up to the aforesaid limit shall not be contingent on the carrier’s negligence.  For such passengers who are traveling with a carrier that is not a party to these special contracts or who are not traveling to or from the USA, or with an agreed stopover within the USA, the carrier’s liability for death or personal injury of passengers is limited in most cases to US$ 10,000 or nearly US$ 20,000.  Names of carriers who are parties to these special contracts are available to passengers in all the ticketing offices of these carriers, and can be viewed on request.  Additional cover can usually be obtained by purchasing insurance from a private company.   Limitation of the carrier’s liability pursuant to the Warsaw Convention or such special contracts of carriage does not affect such insurance.  For further information, please consult the airline company or insurance company representative.

Notice regarding limitation of liability for baggage
The carrier’s liability for loss, delay or damage to baggage is limited to about $9.07 per pound ($21,00 per kg) for registered baggage and $400.00 for unregistered baggage for each passenger, unless a higher value is declared in advance and additional fees paid.  For certain types of valuable objects, it is not possible to declare a higher value.  The carrier is not liable for damage to breakable or perishable items, money, jewelry, precious metals, silver items, exchange notes, securities or other valuable items, business documents or samples, passports and identity documents, included in a passenger’s baggage.  Further information can be obtained from the carrier.

Notice regarding cancellation of carriage
This ticket is subject to a cancellation fee.  The passenger must inquire about cancellation fees and other details with the travel agent/ wholesaler from whom he purchased the ticket.

Notice regarding the imposition of taxes, levies and fees by Government authorities
The ticket price may include taxes, levies and fees imposed on the air carrier by government authorities.  Such taxes, levies and fees may constitute a significant portion of the cost of air carriage and are included in the ticket price or shown separately in a separate box with the heading “taxlevyfee” in this ticket.  The passenger may also be asked to pay a tax, levy or fee that was not charged when the ticket was issued.  The following notice does not apply to tickets sold in the United States for transportation originating in the United States.

Failure to admit a passenger to a flight due to over-booking
In countries where there are regulations regarding compensation in cases of over-booking, air carriers operate compensation plans for passengers with an approved reservation for a flight and who are unable to board that flight due to unavailability of places due to over-booking.  Details of such plans can be obtained from the carrier’s offices.
Air carriers may over-book in order to limit the consequences of non-appearance by passengers and to enable them to give places to passengers who otherwise could not be allocated places on the flight they wanted.

Damage and insurance
Israir is not liable for damage to passengers due to accidents, illness, damage to baggage or any other direct or indirect damage that may be caused to the passenger, including damage resulting from accident, violence, robbery, theft, loss of baggage or documents, flight tickets, passports, hospitalization, medical expenses or any other damage.  It is hereby clarified and stressed that no refunds whatsoever will be given for full or partial failure to use the Services as a result of illness, injury or any other reason.
Israir recommends that passengers insure themselves, at their expense, with comprehensive personal insurance covering the incidents and damage described, including medical insurance, baggage insurance and cancellation insurance.
Israir hereby notifies explicitly that it works to organize the Services solely as a mediator between passengers and the providers and operators of those services, including airline companies, hotels, transport companies, car hire firms and so on, and therefore Israir is not liable, directly or indirectly, in any way whatsoever for any damage that may be caused by such service providers or anyone acting on their behalf, including on account of any actions and/or omissions by such service providers.  Nothing in the foregoing terms affects the passenger’s right to sue all or some of the service providers directly.
