Hand Luggage

Civil Aviation Administration instructions determine that unchecked baggage carried by passengers into the aircraft must be placed under the seat or in baggage compartments.  Therefore the passenger is allowed to carry into the aircraft one (1) piece of carry on baggage which total dimensions (length plus height plus width) do not exceed 115 cm (45 inches), with a maximum weight of 8 kg.  Checks will be performed to ensure compliance with these instructions.

Luggage

The Free Baggage Allowance is to be used solely for the carriage of personal articles for the wear, personal use and comfort of the passenger, excluding valuables and fragile or perishable articles.

Israir Airlines and Tourism Ltd. is not responsible for damage to fragile or perishable items, money, jewelry, precious metals, silverware, negotiable papers, securities or other valuables, business documents or  samples, passports and other identification documents which are included in the passenger's baggage.

The passenger is entitled to 20 kg of luggage without extra payment. On transatlantic flights the passenger is limited to 2 medium sized suitcases of up to a total of 34 kg for both pieces.  This luggage is stored in the luggage compartment of the aircraft.

Addition to the conditions of contract stipulated on this flight ticket

1.                   A. This flight ticket is for a charter flight to be operated by the carrier whose name is       stated on the coupon of the applicable flight. ( hereinafter " the carrier " ) for a Tour Operator ( charterer )  within the meaning of that term in the regulations of charter flights as effected in Israel from time to time. The Tour Operator chartered the aircraft's capacity or part of there of and is acting as an independent operator and not as agent of the Carrier.


B. This flight ticket and the transportation of the passenger thereunder, are subject to the terms of the contract between the Carrier and the Tour Operator ( charterer ).


C. Passenger purchased the right of transportation from the Tour Operator ( charterer )  Therefore, Carrier is not liable for the undertaking of the Tour Operator towards passenger or for the acts and omissions of the Tour Operator ( charterer ), unless such liability rests upon the Carrier according to the contract between the Carrier and the Tour operator or according to law.

D. Tour Operator ( charterer ): Israir Charter ( 1994 ) Ltd and/or Unital Tourism and Aviation Ltd and/or Israir International Limited Partnership.

2.                  Notwithstanding the provisions of para 8 of the conditions of contract stipulated on the flight ticket, this ticket is good for transportation only on the dates and flights specified therein, or on the dates and flights as changed by the Tour operator or its representatives .     

NOTICE:

If the passenger's journey involves an ultimate destination or stop in a country other than the country of departure the Warsaw Convention may be applicable and the Convention governs and in most cases limits the liability of carriers for death or personal injury and in respect of loss of or damage to baggage.  In this respect see also notices headed "Advice to International Passengers on Limitation of Liability" and the "Notice of Baggage Liability Limitations."

CONDITIONS OF CONTRACT

1.       As used in this contract "ticket" means this passenger ticket and baggage check, or itinerary/receipt if applicable (in case of an electronic ticket), of which these conditions and the notices form part, "carriage" is equivalent to "transportation", "carrier" means all air carriers that carry or undertake to carry the passenger or his baggage hereunder or perform any other service incidental to air carriage.  "WARSAW CONVENTION" means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw on October 12th, 1929, or that Convention as amended at the Hague on  September 28th, 1955; whichever may be applicable.

2.       Carriage hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention unless such carriage is not "international carriage" as defined by that Convention.

3.       To the extent not in conflict with the foregoing, carriage and other services performed by each carrier are subject to: (I) provisions contained in the ticket, (II) applicable tariffs, (III) carrier's conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier), except in transportation between a place In the United States or Canada and any place outside thereof to which tariffs in force in these countries apply.

4.       Carrier's name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier's tariffs, conditions of carriage, regulations or timetables: carrier's address shall be the airport of departure shown opposite the first abbreviation of carrier's name in the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carrier's timetables as scheduled stopping places on the passenger's route; carriage to be performed hereunder by several successive carriers is regarded as a single operation.

5.       An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its Agent.

6.       Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants and representatives.

7.       Checked baggage will be delivered to bearer of the baggage check.  In case of damage to baggage in international transportation complaint must be made in writing to carrier forthwith after discovery of damage and at the latest, within 7 days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered.  See tariffs or conditions of carriage regarding non-international transportation.

8.       This ticket is good for carriage for one year from date of issue, except as otherwise provided in this ticket, in carrier's tariffs, conditions of carriage or related regulations.  The ticket shall become valid only when it is paid for.  The fare for carriage hereunder is subject to change prior to commencement of carriage.  Carrier may refuse transportation if the applicable fare has not been paid.  In the event that this ticket was issued for a charter flight, this ticket shall be valid only for the specific flight for which it was issued. 

9.       Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch.  Times shown in timetables or elsewhere are not guaranteed and form no part of this contract.  Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity.  Schedules are subject to change without notice.  Carrier assumes no responsibility for making connections.

10.    Passenger shall comply with government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by carrier or, if no time is fixed, early enough to complete departure procedures.

11.    No agent, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.

12.    The carrier shall not be liable for any damages as a result of a delay of carriage  of  passengers or baggage, all as detailed in the Warsaw Convention and its relevant regulations and amendments.

13.    In case of excess of "weight load" of the aircraft it will be to the carrier's absolute discretion to decide which passenger and baggage will be carried and which passenger and baggage will not be carried on the flight.  Passengers who have been denied boarding on the flight shall have the right to cancel the ticket and to receive a refund of the ticket fare.

14.    The carrier and/or Israir Charter shall not be liable for disappearance, loss or theft of passenger ticket and baggage check and the passenger shall not be entitled to receive a substitute passenger ticket or baggage check instead and        ( charterer )  shall not be entitled to any right for refund.

Notice in case of Flight cancellation.

This ticket is subject to Cancellation fees.

The passenger should enquire with the Tour Operator/Tour Agency from which he purchased this ticket the exact details and tariffs of the cancellation fees 

Notice in case of Flight Cancellation

1.       Except if otherwise provided in this ticket conditions, in carrier’s tariffs, conditions of carriage or related regulations, the passenger has the right to cancel the carriage contract by cancellation notice given to the carrier subject to the following conditions:

1)       If notice is given not less than72 hours prior to flight departure then passenger shall receive refund of flight fare less 15%.

2)       If notice is given less than 72 hours prior to flight departure then passenger shall receive refund of flight fare less 25%.

3)       If notice is given less than 24 hours prior to flight departure, passenger shall receive no refund of flight fare.

4)       In case of cancellation of the carriage contract whereby the ticket is issued on the basis of "undefined date" the carrier shall refund the full fare to the passenger.

2.       The above stated cancellation rules shall not apply to charter flights, for which different cancellation rules shall apply – a copy of which may be obtained from the tour operator or the travel agent.

ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATION OF LIABILITY

Passengers on a journey involving an ultimate destination or stop in a country other than the country of origin are advised that the provisions of a treaty known as the Warsaw Convention may be applicable to the entire journey, including any portion entirely within the country of origin or destination.  For such passengers on a journey to, from or with an agreed stopping place in the United States of America, the Convention and special contracts of carriage embodied in applicable tariffs provide that the liability of certain carriers parties to such special contracts, for death of or personal injury to passengers is limited in most cases to proven damages not to exceed US $75,000 per passenger, and that this liability up to such limit shall not depend on negligence on the part of the carrier.

For such passengers traveling by carrier not a party to such special contracts or on a journey not to, from, or having an agreed stopping place in the United States of America, liability of the carrier for death or personal injury to passengers is limited tin most cases to approximately US $10,000 or US $20,000.

The names of carrier's party to such special contracts are available at all ticket offices of such carriers and may be examined on request.

Additional protection can usually be obtained by purchasing insurance from a private company.  Such insurance is not affected by any limitation of the carrier's liability under the Warsaw Convention or such special contracts of carriage.  For further information please consult your airline or insurance company representative. 

NOTE: The limit of liability of US $75,000 above is inclusive of legal fees and costs except that in case of a claim brought in a state where provision is made for separate award of legal fees and costs, the limit shall be the sum of US $58,000 exclusive of legal fees and costs.

NOTICE OF BAGGAGE LIABILITY LIMITATIONS

The carrier's liability for loss, delay, or damage to baggage is limited to approximately US $9.07 per pound (US $21.00 per kilo) for checked baggage and US $400.00 per passenger for unchecked baggage unless a higher value is declared in advance and additional charges are paid.  Excess valuation may not be declared on certain types of valuable articles.

Carriers assume no liability for fragile or perishable articles.  Further information may be obtained from the carrier

DANGEROUS GOODS

For safety reasons, restricted articles such as those listed below shall not be carried in passenger's baggage without consent of and prior arrangement with Carrier, except that medicinal and toilet articles in small quantities which are necessary or appropriate for the passenger during the journey, such as hair sprays, perfumes and medicines containing alcohol, may be carried without prior approval:

1.  Compressed gasses (flammable, non-flammable and poisonous).

2.  Corrosives (such as acids, alkalis and wet cell batteries).

3.  Explosives, munitions, fireworks and flares.

4.  Flammable liquids and solids (such as lighter or heating fuels, matches and articles which are easily ignited).

5.  Oxidizing materials (such as bleaching powder and peroxides).

6.  Poisonous (toxic) and infectious substances.

7.  Radioactive materials.

8.  Other restricted articles (such as mercury, magnetized material, offensive or irritating materials).

9.  Briefcases and security attaché cases with installed alarm devices.

NOTICE OF GOVERNMENT IMPOSED TAXES, FEES AND CHARGES

The price of this ticket may include taxes, fees an charges which are imposed on air transportation by government authorities.  These taxes, fees and charges, which may represent a significant portion of the cost of air travel, are either included in the fare or shown separately in the "Tax/Fee/Charges: box(es) of this ticket.  You may also be required to pay taxes, fees or charges not already collected.

THE FOLLOWING NOTICE DOES NOT APPLY TO TICKETS SOLD IN THE UNITED STATES FOR TRANSPORTATION ORIGINATING IN THE UNITED STATES:

DENIED BOARDING DUE TO OVERBOOKING

In those countries where Denied Boarding Compensation regulations are in force, carriers operate compensation plans for passengers with confirmed reservations who are denied boarding because of non-availability of seats caused by overbooking.  Details of these plans are available at the airline's offices.

In order to minimize the effect of "no shows" and to permit seats to be used by passengers who otherwise would not be able to travel on the chosen flight, carriers may overbook flights.

Whilst carriers make every effort to provide seats for which confirmed reservations exist, seat availability is not absolutely guarantee
